Overview
If you have lodged a Form 361 Notification of a registered agent to cease acting for a company, you may notice that your address is still listed as the company’s registered office.
This is expected.
Lodging a Form 361 only removes you as the registered agent. It does not update or remove the registered office address.
If you no longer act for the company and cannot facilitate a change, you will need to notify ASIC directly.
How to remove your address
If you no longer act for the company and are unable to lodge a change on their behalf, you should complete ASIC’s online form:
See ASIC website for instructions
This process allows you to notify ASIC that:
- Your address is being used as a registered office without consent, or
- Your address is no longer associated with the company
ASIC will then advise the company to change their registered office address on the company register. If they don’t do this within 28 days, they will change the registered office address to the company director’s home address. This will take effect 7 days later.
You may still receive company mail
Until ASIC updates the address:
- Mail may continue to be sent to your address
- To stop getting mail for a company that isn’t yours, post it back to ASIC marked ‘Return to Sender - company no longer at this address'.
