This article will walk through the process of reinstating a deregistered company.
Currently, Form 581 - Application for ASIC Reinstatement cannot be prepared or lodged in CAS 360.
To complete and lodge Form 581, you must apply directly through the ASIC website: Apply to ASIC to reinstate a company
How to Reinstate a Deregistered Company
There are two ways to apply for reinstatement. The process depends on who is lodging the application:
- An officeholder or member (for example, a Director or Secretary), or
- a third party
If you are a Director, Secretary, or Member of the company, follow these steps:
Name Availability
If you are reinstating the company as an officeholder or member, and want to use the same company name, check that it is still available:
You may check name availability through ASIC's Company and organisation registers
If the name is available, you can reserve it for 2 months:
- Estimate costs and choose whether to proceed
- Request a detailed estimate of fees
- Complete Form 581 - Application for ASIC Reinstatement
- Pay Fees
- Send ASIC the Form
If you are applying as a third party, you will need to:
- Gather supporting evidence
- Complete Form 581 - Application for ASIC Reinstatement
- Pay fees
- Send ASIC the Form
Processing Time
Please note that after ASIC has received your application, it may take up to 28 days for ASIC to complete your application.
